Although you infer, as did I, that MCN nicked Gavsta's picture, in another thread he says he actually sent it to them.
They can do, in a way. In that, by using Flickr you agree to them using your image for their own self-promotion, with buggerall payment to you. Their own self-promotion also includes affiliated companies. Having said that, the other side of the coin is that Getty Images have now set up a Flickr division, sifting through the mountains of dross to find the odd diamond. Best of luck to them, and best of luck to any poor sod whose pic gets chosen, as the profit-sharing is pretty shittily biased towards Getty, as you might imagine.
