  8. Yeah - a little Scam is being run there.
    You see, the points and fines are what effects you.
    So its the degree of the offence that matters to you.

    The court itself has a different angle, merely being concerned with
    your quilt.
    You go in there knowing you've been wrongly accused as to the degree
    of stupid arbitrary limit - IOW, that one point for the fine that WILL
    nail your licence to the trophy board at the RTA, Main Roads or
    wherever is unimportant to the court, and the police know it.

    So, it's simple - the court tells you to **** off because of the scam
    not allowing the consideration of degree.
    You lose.

    And you pay the turds - all of them - whether you like it or not.

    Missed this earlier (even though I didn't block the thread).

    The court has nothing to do with the points, that is entirely up to the RTA
    (or state/territory equivalent). In my last court appearance, the
    magistrate explicitly said that he had no influence over the disposition of
    the points, while the RTA doesn't care about the fine any more than the
    court cares about the points.

    You know the bureaucracy, their main (or only) interest is crossing the is
    and dotting the ts. The RTA (or equiv) gets a report from the court which
    says something like "charged with exceeding speed limit by not more than 15
    km/h, found guilty", and the points are disposed accordingly by the
    relevant licensing authority.

    When you get a fine the allocation of points is the last stage and are not
    applied until the matter is finalized, either by you paying the fine or a
    court making a decision.

    That was explained in the paragraph above. The points come free of charge
    with every relevant driving offence. You don't go to court to dispute the
    points, you dispute the charge. If you're charged with say speeding by 40kph
    and that is worth 4 points, you pay the fine to the cops (or whoever collects
    the money) and they advise the RTA and the RTA gives you points according to
    the offence you've paid the fine for... ie 4 points. If you take the matter
    to court and the magistrate finds you not guilty of exceeding by 40kph but
    does find you guilty of speeding by say 10kph then the RTA is notified of the
    magistrate's decision and they allocate you points according to the offecce
    the magistrate found you guilty of.. ie 1 or 2 points or whatever is
    applicable for 10kph.

    having been established means that the charge, which *included* the
    matter of degree - stands.


    So, which is it?
    Could it be that many of the stupid arbitrary limits are in fact not
    legal? :)
