The legislation would have to be framed to define him as a passenger, and as such, he'd need to be sat on the pillion seat and able to reach the footrests. I'm not sure whether the helmet law includes a specification for dogs. I'd be minded to assert that he should be considered to be livestock - you don't see animals in the backs of lorries wearing seatbelts.
