    Managed to crash last Friday. car in front stopped behind a bus
    dropping off, and I decided to overtake them, the car then decided
    without warning, to pull out, exactly as I was passing her door.
    Whallop, only 20-25 mph, but punted me across the road, bike into a
    wall, me along the road about 5metres. Upshot is an operation on the
    shoulder, that has the tendons ripping the bone to bits, apparently
    enough for the surgeon to be unable to get screws in, so I'm fucked for
    between 6months and a year.
    Anyway, any ideas on insurance liability with apportion of blame? Or
    are more details neede? A witness came over and said it was obviously
    not my fault, but how far will this help.

    its only the fairing, lights, front forks probably and oil all over,
    but repairable? not by me, thats what insewerance is for.
    It was time for a change anyway, I was looking at GSXR1000 but would
    only get 3k for mine, so didn't bother

    are a good thing if they can be made to write a letter.

    You're pretty much screwed, if past events are a guide. It's the
    responsibility of the overtaking vehicle to avoid collisions, and it's
    almost impossible to prove that the fault lies with the vehicle being
    overtaken.

    Sympathies, and all, of course. Seems like the cripple club is growing
    apace at the moment.

    this one can, she stopped and ran over to me, but I was busy trying to
    further wreck my shoulder by picking the bike up cos it was pissing oil
    all over. She did try to get me to go to hospital, but I thought I was
    ok at the time, adrenalin etc. While waiting of the wife picking me up,
    the pain set in, and in, and in.
    I phoned later to thank her for giving her name etc. so hopefully she
    will serve as a good witness
    Ta muchly.

    from nowhere at approx. 40mph. That's my guess.

  14. This includes ensuring that nothing is already overtaking you when you
    pull out. IMO the OP has a good case, especially as he has a witness on
    his side.

    To the OP, try http://www.whitedalton.co.uk/ . They did a sterling job
    when my mechanic wrote off my RSV when some blind **** pulled out on him
    as he was test riding it after servicing it.

  15. My first lawyer was all for rolling over and letting the insurance
    company shaft her, the useless tart. She actually recommended I take a
    miserable settlement, just because she a)couldn't be bothered, or
    b)didn't actually know how, to do her job.
    I fired her, pronto.

    I think a lot of riders get shafted by her type of lawyer,
    unfortunately.

    I also won a case that had similar circumstances (he'd pulled over
    behind parked cars to read his map, I overtook assuming he was
    parking, and he pulled out without looking).

    It took a very long time to win though.
