    Why? I cannot blame the witness;-)
    Looks like I'm partially disabled so I may have to. It also seems that
    although I get full pay for 6months, I have to claim in case my
    employer needs to claim.

    Thanks Ian, I have bookmarked it, but I do have legal cover for now. I
    will go with them for now. They phoned this morning to tellme to get my
    finger out and find out what the insurance are doing about the bike, so
    it seems they are being proactive.

    This sounds really boring and tedious, but keep a daily diary of
    related events; time, date, and gist of: phone calls, letters received
    (keep copies of letters sent); print out emails sent and received
    (with their headers); visits to doctors and hospitals; ditto
    solicitors; every penny you spend as a result, inlcuding bus fares,
    stationery, phone calls, pin killers,etc etc etc.

    Get a biking-experienced solicitor on your side.

    Write in your own words ASAP exactly what happened at the time: don't
    put supposition in, just facts; a description and other details of
    witness - a prize beyond price in this game; damage to the bike that
    you were aware of at the time. Add facts as they pop in to your
    memory. Draw a sketch map; supplement with sat photos.

    In a couple of years time, you'll need to know this sort of stuff, and
    it's very easy to forget things..

    A quick FU: My other half was in a car that was side-swiped by a
    foreign artic, and suffered severe whiplash.

    I got a biking solicitor's name from the motorcycle press, talked to
    him over the phone about the accident, and he took it on.

    It took seven years to settle, and my other half got a settlement that
    even twenty years later hasn't been approached in value in TV adverts
    for 'look what we got this person for whiplash'.

    Expect this to take a very long time (hence the diary), so don't rush
    anything.

    I think he means that TV adverts for no-win-no-fee solicitors
    say things like "This fellow got £1000 compensation for whiplash"
    and his other half got much more.

    I got eight grand in about 1992 for whiplash, which wasn't much
    for a lifetime of pain and restricted movement. I don't know if that
    was good or not.

    The ambulance chasers/no-win-no-fee solicitors that advertise on TV
    have never mentioned an amount of damages for whiplash anywhere near
    the amount my other half got, in an accident that happened all but 20
    years ago. You'd think they'd put their bast cases forward in
    advertising their record.

    If they advertise those amounts in settlement, for injuries that seem
    to be worse that MOH suffered, then either my solicitor did
    exceptionally well, or the a-c/n-w-n-f settle too early.

    MOH got much the same amount.

    A physio taught me how to located the knotted muscle/nerve, and
    massage it away. I became expert at it over a number of years. Final
    upshot was no lasting physical pain or discomfort, or limited range of
    movement - but it meant that MOH's plan of teaching the kids Suzuki
    violin went all to bantam.

    Some of these lawyer types are "good" [1] at getting compo. A woman who
    works in a sandwhich shop near me slipped and fell in the shop and gave her
    knee a smack. She claimed it was her employers fault as there was
    "something" on the floor (actually, there wasn't, but hey ho, it's a fucking
    buttie shop and things occasionally spill/drop/whatever) and it eventually
    went to court.

    The woman was walking the same day as the "accident" and has continued to
    walk every day since. She got 15 grand for her injury.

    Sorry to hear of your problems.

    At the risk of being shot down in flames, I've been round the loop a
    number of times and can suggest diet and supplements that can help
    with the arthritis, if you wish.

    OTOH you might well be sick of people telling you what's good for you,
    in which case I'm sorry, and I won't mention it again.
