Cheeky little pirate

    I'm not denying that it's a breach, what I am curious about is other
    than taking out an injunction to stop him continuing to distribute
    copyrighted material, what more could EMAP possibly sue for given that
    the content is on something they've made available for free, with no
    terms and conditions to agree to before download.

    It would be almost impossible to prove any kind of financial damages,
    I'd have thought.

  3. The point I made earlier is that they'll really put the frighteners on
    him.

    They'll also trawl through his past auctions, and any that look like
    they might be him under a different username.

    They'll do the same for the classic car ephemera auctions. Because I've
    suggested that if he's pirating one sort of mag, he's very probably
    pirating others as well.

    Quite possibly other categories too

    Now, if it turns out he's been at this large scale, they *will* pursue
    him for some form of settlement. And their legal fees.

    If it's just an isolated occurence, then he'll probably be given a very
    stern order not to do it again, have to sign an agreement to that
    effect, and (in all probability) pick up the legal costs there if he as
    much as squeaks.

    The very least that can happen is he has his Christmas ruined. Good.

    A few years ago, I was involved in a case where some work I did (not
    freelance) was pirated. Seriously, publishing companies do not like it.
    It's bad enough if someone's just reproducing something unauthorised -
    generally they just say 'Stop doing this, please' - but if someone's
    actually *selling* their stuff, they do take it seriously. Trust me on
    this.

    EMAP can sue the perps for millions, it matters jackshit as if/when it
    goes to court he'll be made to pay it back 50p a week, whilst earning
    hundreds of untaxed UKP a week, undeclared to the authorities of course.

    Talking of which, the exhaust gaskets on mine incinerated and started to
    chew the rubbers. Johnny is sending replacements. Lucky I was putting a
    new RH silencer on!

    One new head obtained, another in pipeline so the DG's will be up for
    sale soon. That will pay for the new seat/siderails, the silencer just
    fitted, the rear mudguard I've got coming, Newtronic and a proper model
    points cover.

    I shall be a very happy bunny.

    They have a habit of destryoing the exhaust joining rubber's internal
    gaskets if the engine mounting rubbers are worn, I'd check those too.
    Are the internal gaskets Yamaha originals? I'm sure they are still
    available if the ones you have aren't.
    Very nice. When are you going to pull the whole thing apart to paint the
    frame?
