Cheeky little pirate

    Indeed. We decided it was easier to take a step sideways to defuse the
    situation rather than enter into a legal battle where we were
    technically in with a chance of winning but financially didn't have a
    cat in hell's chance.

    I understand that the "Old Bike Mart" case is still rumbling on.

    People selling pirated stuff deserve everything they get, though, and I
    hope they get a much less gentle and polite treatment than we did.

    OK, here's what's happened so far.

    The two clowns selling the pirated stuff have both been contacted by
    the lawyers, who, it would seem, made their displeasure clear.

    One tried some flannel, and then got a bit panic-stricken and has
    agreed not to do it again, thank you sir, probably realising he's had a
    narrow escape.

    The other, it turns out, has been quite a busy little bee, and has made
    a few hundred quid from his copying. With him, negotiations are still
    proceeding. Apparently, he's a little bit panic-stricken too. And that
    was only the first bit of digging that turned up how much he'd sold.
    Who knows if there's more to come?

    Also, who knows if it's just restricted to Classic Bike? It's unlikely
    that someone pirating stuff is only restricting themselves to one
    single magazine, IYSWIM.

    Possible outcome here: surrender of all monies made from his sales,
    plus the signing of some very legal documents, and the payment of some
    very legal fees.

    Ah. Haven't checked since the last update, actually. The gist of that
    was:

    Classic Bike (or rather, EMAP's legal eagles) discovered that of the
    two clowns doing it, one had only flogged three or four and was happy
    to accept a stern "Don't do it again" warning.

    The other had made a couple of hunded quid out of pirating CB Dossiers.
    Bear in mind you can only search auction details up to 60 days old on
    Ebay's site. So it's quite possible (indeed, likely) he'd been at it
    for quite some time.

    It was also suggested to the legal bods that they might enquire after
    other magazines. Someone in my office said that (of all things)
    knitting patterns from the knitting magazines are frequently pirated. I
    must say I wouldn't have thought of that (I was thinking along the
    lines of the classic car mags), but yes, I could see her point. It is
    considered very unlikely that he's only copying CB stuff, anyway.

    AIUI, the job is now to find exactly how much stuff he's been pirating
    and what. There are two ways to do this: tell him to make a completely
    clean breast of everything, or to persuade Ebay to open up their files.
    Or both. That would take time.

    It is unlikely that any lawyer will let him keep the ill-gotten gains,
    so I imagine (as I say, I haven't been pursuing the matter) that he'll
    have to pay it all over. I also imagine that he'll be looking at some
    hefty legal bills. I can't see it going to court, because I can't see
    him being silly enough to contest it.

    I do know that they came down on him, hard, once they discovered t
    wasn't an isolated incident, and once they discovered he'd been making
    an appreciable sum from it, and that he wasn't just being let off with
    a warning, as per the other clown. I was told that he called EMAP up,
    "very frightened".

    So, as I suspected, that was his Christmas spoiled. Silly bastard.

    I'll try and get some more info.

    legal action but is now reported to be reconsidering its position after
    a civil liberties group said that using intellectual property for
    parody was protected under the US Constitution.

    OK, latest info is that they've backtracked as far as they can on Ebay
    (which is 60 days, as you know) and he's made £800 in that time. The
    enquiry continues.

    Those who shouted that nothing could be done, and that he'd get away
    with it, and what was the point of pursuing him anyway, etc etc etc,
    are invited to consider what they think is likely to happen now that
    the lawyers for a very large publishing company have discovered that
    someone has been pirating their stuff and earning (pro rata) about
    £5000 a year doing it.

    And that's only the stuff they know about, of course.
