dangerous and culpable driving

  6. If I drive in manner dangerous to another person and have an impact with
    that person and they die, under the NSW Crimes Act I am liable for 10
    years imprisonment. If I drive negligently and I have an impact with
    another person and they die, under the NSW Road Transport (Safety And
    Traffic Management) Act I am liable for 18 months imprisonment.

    The first is a criminal code, the second isn't. The first has harsher
    penalties. Otherwise, what is the difference?

    I wasn't commenting on how the system works. I was making some
    assertions which you seem to think were vague. I'll reiterate them
    for you so that they will become less vague, paul:

    [1] It was correct charge him with culpable driving.

    [2] The issue of "intent" is bollocks with regard to [1].

    [3] He should have been found guitly of culpable driving. The jury
    were sucked in by defence rhetoric and the DPP ought to appeal their
    verdict.

    Is that too vague for you, paul, or do you understand what I'm
    asserting?

    Well let's just see what sort of a sentence he gets, and if it's
    laughable light, we can revisis this.
    That's one account. Others put his speed much higher.

    Then there's the matter of having his kid in his lap.

    Then there was the fact that he was warned about the possibility of
    drunk teenage partygoers on the road and advised to drive carefully.

    All in all, I'd say a blatant disregard for his life, his son's life,
    and the lives of any partygoers who might be on the road. I'd call it
    reckless. I'd call it hoonish. You can call it exemplary if you
    wish. As I said - a whitewash...
    Clue: When there's roos around I never travel over 80kmhs. I'd use
    the same logic if I knew there was a distinct likelihood of
    encountering drunken teenage party goers on the road. I consider
    that common sense, and responsible driving. He was playing Russian
    roulette with his life, his son's life and the lives of anyone on the
    road that night. As it turned out six died, and he could easily have
    killed his son and himself as well.

    Speed limits don't come ito it. Given the conditions: night time,
    warning of people possibly on the road, letting kiddie play "driver",
    I'd say under those conditions he should have been doing 50kmh max.
    Had he secured his son proplerly, I'd say 80kmh was max safe speed
    till he was well and truly past the partygoer "zone".

    e.g. in our street (a crescent) there are often small kids playing on
    the road. I never exceed 40kmh even though the limit is 50. To do
    50kmh would be , in my book, given the prevailing conditions,
    dangerous and in blatant disregard of those kids' lives.

    You on the other hand. appear to operate on the logic that if you hit
    someone it's their fault for not getting out of your way. They had no
    right to tresspass into your universe and you are not responsible for
    the outcome.
    No, the tag hooning fits as far as I'm concerned. As I've said, you
    have along track record for being an apologist for hoons. Given you're
    a hoon yourself, this is hardly surprising.

    And when the DPP appeal his verdict and get him convicted of culpable
    driving, what charges then do you think we should bring against the
    drunk teenagers on the road... and why is it that none of them been
    charged with any traffic offences or offences related to underage
    drinking?.. and why hasn't anyone been charged with supplying alcohol to
    minors?
