FOAK: Debt recovery in France

Paging the FOAK aka UKRM

Anyone got any idea What's the best way of recovering a debt (3,500
euros) from a company from here in the UK. They seem intent on dicking
me about and I've had enough as they are now 3 months overdue with
payment.


FWIW, they are a large and solvent company Paris based company - I'm a
one relatively skint man band.

 

Heh, I've not got any experience with debt collectors.

 

You send a letter called a 'mise en demeure'. Try this for size ...

Fifteen days after you get notification that they've received it (send
it recorded), you 'seize' the judge at the Tribunal d'Instance of the
arrondissement where the company is located in Paris. The address is in
the Yellow Pages (( http://pagesjaunes.fr/ ) type 'tribunal d'instance'
and the postcode, for example '75001', '75012', '75007' etc..). To do
that, you write to them, outlining the different aspects of the case,
and ask that they force the company to pay.

Any idea of approximate costs?

 

Taking him to court should be free. But if you send the 'mise en
demeure', he might cough up. They're pretty scary letters to get,
especially by recorded (or 'LRAR' as we call them).

Thanks - I faxed [1] the company's 'Presidents' office saying get on
the case or the shitty letters on the way. It seems to have desired
effect.

It would appear we are about halfway there from a standing start at
nothing and as an added bonus a couple of arses have been well and
truly kicked.

I await tomorrow with interest.
