Gatso fine - unlicensed rider!

    Hi,

    A mate of mine (truly) has been a bit silly.

    He was riding a motorcycle without a licence (he has a full car
    licence) and got flashed and has received a penalty.

    Does anyone know if they will check the reg of the bike, find out what
    CC it is and then check to see if he was properly licenced for it?

    Or, if the fine is paid and licence submitted to apply the points will
    it go unnoticed that his licence didn't cover him? His car licence
    covers him for up to 50cc provisionally I believe.

    Cheers for any advice.

    Will they not request a copy of his licence so they can add the points
    to it?

    I guess if he has received a fixed penalty notice, then paying it will
    just tidy up the paperwork (/computer file) and it'll be over and done
    with.

    Keeping quiet and sending the cheque has got to be worth a try, unless
    he's got someone prepared to take the 3 points.

    I'm not sure what a 50cc provisional would be, in all honesty.

    Has he done his CBT?

    If he's unlicenced, then he's uninsured too.

    An IN10 is worth 6-8 points
    An LC20 is worth 3-6 points
    An SP30 is worth 3-6 points

    In theory he could get all of those and I'm sure riding without
    L-Plates probably gets you 2 points a piece.

    Perhaps there was no film in the camera. The registered keeper should
    get an NIP within two weeks if he was zapped properly.

    Bah, didn't see that.

    Whoops! I guess he needs to pay the fine and hope, invent a friend
    from abroad or find someone a bit more senior who has Cat-A on their
    licence who doesn't mind taking the points/fine/insurance premium
    raise who would also risk "no insurance" should he be given a
    producer.

    Tell him to send a cheque off to pay the fine with his car licence. It will
    probably be processed by a clueless/lazy bureaucrat who will not cross
    reference the vehicle details with his licence entitlements. He'll just get
    3 points on his licence.

    If the discrepancy does get noticed then he will have to take the
    consequences like a man. He took a risk and getting caught was part of that
    risk just like any of us that breaks the speed limit.

    My main concern with your friend is that he was willing to ride without
    insurance. This is a particularly cuntish thing to do IMV. Part of me hopes
    that the bureaucrat has just put in for promotion and is keen to impress
    his overseers.

    Yes, but all they will be processing is a SP offence surely ? The processe
    will unlikely see other details.

    Personally of greater concern is the fact he was riding uninsured.

    If one of us was in a "non fault" collision with an uninsured rider we would
    be well pissed off.

    Riding with no insurance is not on, of course.

    Trouble is, IIRC, class P is 50cc max and a max speed of 30mph...

    Which kinda suggests a degree of Gatso immunity...

  11. Inventing a friend from abroad is not a good idea. They're all onto that
    trick now, as the couple last week whose £120 for 2 flashes became ~£11,000
    in fines and possibly more grief from their professional [well, estate
    agents'!] association, when they thought they'd be clever [well, estate
    agents!] by inventing a Bulgarian friend.

    Very much out of character for him - not that that is a defence - it
    was a mad moment thing I think.

    Truth is that thankfully there wasn't any form of accident so the
    potential disaster didn't happen.

    He certainly won't ride without insurance again!

    You could............. quickly get a mechanic to restrict the power of
    the bike to that of a 50cc. What is it ... 17 bhp ? 500 is 33 or summink
    innit?

    The law is based on the power output of the bike not the cubic capacity
    of the engine.

    Of course I have absolutely no idea how one would go about this , it's
    just an idea.. but one I'm sure is possible if worst came to worst!
