    IIRC the NIP has to arrive within 14 days otherwise it's no longer
    legally binding.

    Has to be *issued* within 14 days. If it never arrives the police can
    just say it was issued 7 days after the flashes but it got lost in the
    post.

    Two options

    a) pay the fine and hope no one notices

    b) He could not reply at all to the NIP, S172 notice. This would
    probably result in a conviction for failing to identify the driver (3
    points & prob £250 fine) (gatso photo would not be good enought to ID
    him, and he cannot be forced to take the stand). It's worse than
    being convicted for speeding, but not than speeding plus no insurance
    etc. As he would have not admitted to riding his lack of
    license/insurance should not be an issue.

    I suggest he takes a look at the fightback forums on www.pepipoo.com.
    They will also recommend specialist solicitors.

    What would happen if it did *really* get lost in the post? Would you end
    up going to court because Royal Mail fucked up?

    Just to clarify a NIP and S172 request are different documents
    (although are often combined into one). For the NIP part to be valid
    it must be posted by first class post (or better) so that it would be
    normally be expected to arrive in 14 days or less i.e. posted on the
    13th is OK. This only applies to the first NIP sent to the registered
    keeper (at the address on the DVLA database at the time of the
    offence - if you didn't get a NIP later because you moved house on
    the day of the offence the >14 days doesn't matter).

    The S172 request to name the driver is valid irrespective of whether
    the NIP is valid or not. I.e. if the NIP arrives late you can't be
    done for speeding, but you still (in theory) need to name the driver
    to avoid being done for the S172
    There maybe a grain of truth in the above. I think where a S172 is
    sent by first class post it is a 'rebuttable presumption' that the
    S172 was served. If you have the balls/credibility to rebut this
    presumption and swear under oath that you never received it (bearing
    in mind that a perjury conviction will result in a prison sentence)
    then you should (and some apparently have) got off. I think this
    usually works where someone has unknowingly been convicted under s172
    and applies to the court for it to be re-tried - its usually too
    late (> 6 months from the offence) to then issue a summons for
    speeding.
