    Like the bloke in Dandenong on the news this morning?
    No licence, over the limit, took out a couple of posts and a car before
    demolishing a 1.5 metre wall which had six primary school children sitting
    on it. Fortunately none of them died but one has serious leg injuries. No
    sense in allocating him any points and two years is probably not enough.

  2. I've amended the speech with your recomendations. I spoke to the constable
    in the police station this morning who believes everything i have written
    here is relevant in showing that usually i am a good driver/rider and the
    explanation of the event helps to show that i was not completely driving
    without care or attention.

    He expects $300 or $400 fine and probably no loss of points. I hope he is
    right.

    Thanks so much for your help GB. Unfortunately i am no lawyer either, so any
    guidance or experience i can take from others is extremely helpful. I shall
    let you all know how it goes.

  6. Yeah well, Marko and I have been on the recieving end of a brain-dead
    Landcruiser driver who had to mow me down to get to Marko, who then
    immediately went into the "it wasn't my fault" blame-storming mode...

    "Look at the size of the brakes on that thing,", he said pointing at the
    mangled remains of Markos R1, "how could I possibly stop as quickly as
    that?", clearly implying that obviously gave him some innate right to
    plow his lumbering 4WD through other, more agile, roadusers...
    Fortunately the cop at the scene though otherwise - unfortunately only
    to the tune of a 3 point ~$180 neg driving ticket. At least that made my
    insurance claim easy - Marko hasn't been so lucky, he's still undergoing
    physio some 3 and a half years later...

    So yeah, I have a personal issue with losers who run into that back of
    other road users for no good reason, but even allowing for my bias, Josh
    is clearly in the wrong. Like everyone always tells you, you run into
    the back of someone its almost _always_ your fault. You need to come up
    with a spectacularly good reason for it to be otherwise, and whining
    that "its not fair, I was looking the other way to see if I could merge"
    is, quite frankly, a clear admission of "public stupidity" - or as the
    police have determined, a "failure to pay due care and attention".

    If _I_ was the judge, I'd be revoking his licence, and making him go
    through the whole learners/driving test/provisional licence thing again.
    If he'd hurt anyone through his stupidity, then the maximum 6 months
    jail could easily have looked way too lenient...

  9. Ended up with a $200 fine and the reccomendation that i give up motorcycles.

    It reinforces my belief in the, er, belief that it's mostly pretty
    easy to get off with a bit of contrition and due deference because
    they (contrition and due deference) are very rare commodities in
    this world.

    American television, unemployment benefits and general land rights
    for gay whales have created a 'system' where dodgy wankers get to
    stumble in, tell the Magistrate "Not guilty yer 'onna" and get off
    whatever they did for a thousand dollar fine. You only have to steal
    six or eight more televisions to pay the fine (or better yet, cry
    poor mouth and get off the fine too) and you're back to square one.

    So if a thousand bucks is the going rate for a drug addled f*cktard
    in a singlet and shorts calling the Magistrate "poofter", then when
    someone like Josh shows up, properly dressed, suitably contrite,
    delivering appropriate levels of respect, using the right
    terminology and generally being, well, coherent, then what the hell
    is Her Worship supposed to do???

    When they have a shoot-on-sight arrangement for anyone who doesn't
    behave appropriately in a magistrates court, then the game will
    change, but in the mean time... folks who behave appropriately
    get appropriately (relatively speaking) rewarded (or should that
    be dis-punished).

    An apparently famous Mexican actor, Edgar Ponce (sounds like a mate of Bobby)
    was killed and three other riders injured 2 weeks ago when I car ran into the
    back of the group of bikes they were riding through Mexico City while filming

    Lucky bastard, I never got one of those[1] myself. Did help
    a mate get one a couple of years ago tho: I was a character
    witness, told the Magistrate that he was a really great
    bloke and quote "his staff love him" unquote. (The absolute
    truth too, he is a fantastic guy who had no business being
    on the receiving end of the charge IMHO).

    It went off magnificently well, *and* had lasting effect.
    Her Worship quoted my testimony back as a key reasong for
    finding the offence proved but not to be recorded (which is
    the point of the old[2] 556A section) when she summed up,
    *and* his wife was there to hear it. His wife was so
    impressed that to this day she gives him a pub pass every
    time he tells her that he's going drinking with GB! :)

    [1] Section 556A of the NSW Crimes Act 1900 as amended gave
    courts the power to discharge an offender without
    recording a conviction against them under various
    circumstances and with various conditions. It is (was)
    applied in situations where a charge was proven according
    to the letter of the law, but where there are extenuating
    circumstances: the offender is of particularly good
    character, the offence is particularly trivial, etc.

    [2] The aforementioned section 556A doesn't exist any more. An
    equivalent function exists in section 10 of the NSW
    Crimes (Sentencing Procedure) Act 1999 as amended.

    Iain I've _never_ been able to pay attention to more than one thing at a
    time, and I manage fine :)

    I do it by changing that 'one attention unit' from item to item to item
    in a regular, systematic pattern quick enough that it gives the
    _illusion_ that I'm doing several things at once.

    Sort of like computers that time share rather than multi-task... the end
    result is similar, but the methodology is different.

    I would add that I've only had 1 serious accident, and a couple of minor
    offs in 25 years, but _all_ happened when several factors combined
    occured at the same time (or close enough to the same time as to make no
    difference).

    *shrug*
    At least I'm aware of the issue, and I've developed riding skills which
    tend to compensate.

    I strongly suspect many people are in a similar situation, but haven't
    analysed the question...

    After all... (cue sterotype) How many males can multi-task? *grin*
