One of the minor off's I mentioned was when I ran up the back of Jeffles
in the UK. I'd been following him through the hills, and he'd been
travelling quickly on the speed triple, I'd been managing to keep up on
the old mid 80's GT750 Kwaka but I was working _hard_.

I saw a roundabout ahead and Jeff put his brakes on, and I put mine
on... except that my front lever went _straight_ to the bar... leaving
me with rear brake only. The front fluid had boiled.... I skidded (rear
wheel locked up, crossed up, getting as much weight as possible onto the
rear, in a cloud of smoke) right up to jeff (I tried to dodge around but
it was a narrow entrance to the roundabout). I almost skidded past but
my foot peg clipped his muffler and he went "oops... balance... errk....
slow motion tip over", and I stopped about 3 metres into the roundabout.

Jeffles did the maintenance checkover on the GT750 before I came over,
and I checked it again when I got there. Neither of use saw any
discoloration of the brake fluid or saw any problems with the brakes
    (which tested and rode fine).

I paid jeffles for the bits he'd broken (I insisted), and we got them
    fitted.

ok... big... whose fault is this 'rear ender' ? (honestly... I'm curious).

Technically still your fault since your brakes failed.
That's how the law would see it.

Hmmm well you know... when I went to stay upright's advanced rider
training course one of the things they stressed was "trust your bike,
don't worry... it has lots more capability than you do" :)

The study I read said that roughly 85% of males and 15% of females have
'male-type' brains, and roughly 85% of females and 15% of males have
    'female-type' brains.

The so called 'female-type' brains showed more interconnections between
the two hemispheres of the brain, and it was hypothosised in this study
that this could be at least part of the explanation for the superior
multi-tasking ability demonstrated by those with the so called
    'female-type' brains. [1]

That's probably what the legal eagles would say!

I reckon we did the right thing by fixing it but...

  11. In your situation, I would have considered myself at fault for that
accident. (as, I suspect, did you - which I think is why you insisted on
    paying)

Ut seems to me that "working _hard_" on an unfamiliar bike is, while
perhaps not "asking forprobelms ", certainly increases the risk of
    uncovering mechanical faults.

I don't agree with Clems "King Solomon" solution either - Jeffles sold
you (and "did the maintenance checkover" on) an "old mid eighties
Kwaka". It ended up exhibiting what in my opinion is a typical
malfunction for a bike like that. Most people are lucky enough to
discover brake fade in somewhat less expensive circumstances, but just
cause you were unlucky about where the brakes gave up on you, that
doesn't make it Jeffles problem. If he'd sold you a "new enough" bike
that you would reasonably consider the brakes to be up to scratch, or if
he'd told you that he'd rebuilt the brakes and flushed the fluid,
_maybe_ you'd have some claim that he may have been contributory somehow
to the accident, but with a ~20 year old bike?

(Now ask me how my opinion would have changed if he hadn't sold that
bike to you, but just lent it to you...)

A bus with ample forex? Is this a Queensland thing?

Drove the Shire Coaster a few weeks ago. Nice vehicle. Could use a set of
shocks, an engine and a new body. Mostly the shocks though.

I had a gut feeling that 'felt' like that, but I honestly had no real
idea of the legal situation. I would have paid anyway but...
Probably. I actually owned exactly that model for some years though.
It took about 1 day to fall back into the groove that a familiar bike
gives. I never experienced total brake fade like that on mine though :)

I suspect that the owner that jeffles bought it from never pushed it
that hard (whereas I used to push the one I had over here hard).

It's hard to know what sort of brake fluid was in the bike, probably
generic dot 4, which I didn't use out here.
This wasn't 'brake fade', brake fade is when the lever gets spongy and
the brakes get lots less effective. This was brake failure without
warning and the lever coming back to the bar with _aero_ resistence
    *click... bar*.
errmm I'd have felt obligated to fix both, instead of fixing jeffles
    bike and patching mine.

I was more referring to Tasvegia :)

Most victorians don't mind sydney, it's got an almost non existent
freeway system but it's a prettier city near the bay than melb is.

No freeways doesn't matter much when one is bike mounted anyway...

What you talking 'bout Willis? Sydney is an absolute shithole of a place to
navigate around if you don't know where you're going because there seems to be
a distinct lack of straight line roads from one place to another, esp in the
inner city and near the coast... and they seem to squeeze extra lanes into
their roads by making the lanes so narrow that there's no room to lane split.
