Hypothetical License Question

    So, what classification does a "moped" come under in NSW?

    Presumably it'd be classed as a "motorcycle", which a QLD car licence holder
    wouldn't be licensed for in NSW......

    It's all irrelevant because we should have a standardised national system.
    WTF we need each state and territory to replicate beauracracy and waste tax
    payers dollars on unique rules is beyond me.

    Would I have gotten costs though is the question?

    It's not worth driving 200kms after work, staying in a motel, paying for
    a meal, taking the next day off work, paying a solicitor (or a
    barrister) going to court if all one gets out of it is the fine squashed.

    I wasn't aware of that requirement to be honest. This isn't a work
    trailer, it's actually my own trailer.

    I *was* carrying work stuff in it (hence my work related comment) but
    only because I didn't want to get the back of my wagon covered in grease
    (the work ute was somewhere else).

    The award currently says I get 62 cents a km for using my own car (it
    was less back then) but mentions nothing about trailers and I wasn't
    recieving any sort of reward or payment for using it.

    I'm not sure what that all means except I'm now more confused :)

  10. Good luck with getting an answer for this - even direct from either Qld
    or NSW RTA.

    We encountered the problem a few years ago, when travelling interstate.
    Carol had a learners, which meant that in Qld (under her licence
    conditions) she had to be accompanied by a rider who had held an open
    motorcycle licence for at least 12 months. She could ride at the 100 kph
    State limit.

    NSW had the rules that you don't need to be accompanied if on a
    learners, but were restricted to 80 kph.

    I couldn't get a straight answer from NSW RTA. The best they could do
    was to advise to "ride to the NSW road rules AND to the Qld licence
    conditions". I asked if this meant accompanied AND no more than 80 kph?
    I was advised to "ride to the NSW road rules AND to the Qld licence
    conditions". Obviously no one was going to try and make a call on it.

    However, I did learn later that a NSW learner was booked for riding in
    Qld without being accompanied.

    Unfortunately, that's usually the case. It's the price of standing up
    for oneself.

    I was in court once in Sydney on a parking infringement matter, and
    there was guy who'd flown up from Melbourne to defend a parking
    infringment matter of his own. He felt that the infringement notice was
    unfair, and was willing to spend his own money to make that point.

    It doesn't matter what NSW classifies it as because the Qld licence
    qualifications are quite clear; (from memory) no more than 50cc, no gears,
    max speed 50kph, solo seat only. If it fits those specs (and it's
    registered and roadworthy) the Qlder is licenced to ride it in ANY state.

    Even if you get an answer, you won't know whether it's correct, and if
    it's not correct, and you get booked, the fact that you got the wrong
    answer from the RTA would not be a defence.

    A mate of mine was legally riding a Z1300/6 Kwakka here in Brisbane when he
    was 16yo 'cause he had a Norfolk Island licence.
    No-one had ever thought of restricting licences on an island just 5km long
    with a 50kph speed-limit!!

    Why are people relying on hearsay and second hand info instead of
    listening to the facts? (or checking the relevant legislation.)I
    remember being told by all and sundry including policemen that I could
    not tow a car with a rope, had to use an A frame, could not drive in
    bare feet or thongs etc. They swore black and blue that this was the
    case. None had read the traffic act, just believed blindly what they had
    been told.

    When you are in another state, you must abide by the local rules

    My son in the ACT whilst on his learners could ride a Harley in the ACT, but
    he couldn't ride it in NSW
