"Identity theft" and fixed penalty notices

    I have just spoken to the Clerk's office about the D&D FPN. They didn't
    sound at all surprised. The bloke I spoke to said that more effort should
    be made to check identity before FPNs are issued so it seem this is quite a
    common occurrence. He gave me the number of the police fixed-penalty office
    and said that if I rang them and explained the circumstances they would
    probably withdraw it. So I rang the police fixed penalty office at 3.05pm -
    and got a recorded voice telling me that their opening hours are 9.30 to
    3.00pm! I will try again tomorrow.

    Whilst there is no statutory requirement for an appeals procedure
    against fixed penalty notices for *environmental* crime many local
    authorities do actually have one. TBF, some of those are issued without
    any admission.

    I'm surprised by the one that implies that goods will be seized without
    any further court hearing. The next step if a FPN is not paid within the
    stipulated time is usually a summons to appear in Magistrates' court.

    Definitely a case for a pre-emptive strike then, pointing out that your
    son demands his day in court and that you anticipate that his costs will
    be considerable. Though, when we were talking about the shotgun affair
    IIRC there was a recent proposal that the successful defender of some
    classes of prosecution should not get their costs.

    You are certainly entitled to go ballistic, though not literally I hope.

    ISTR that it was only for motoring cases that full costs would not be
    awarded - they would only award the legal aid rate and the motorist would
    have to pay any additional amount if he/she had engaged a solicitor. The
    next step will be to disallow legal representation altogether in motoring
    cases, followed shortly afterwars by legislation making it a criminal
    offence to deny your guilt when accused of motoring offences. This will
    done in the name of the taxpayer as it will save huge amounts in costs and
    maximise the revenue stream. Naturally some innocent people wil be convicted
    but they should be proud that their sacrifice will ultimately be for the
    good of all. YKIMS

    Are these actually Penalty Notices for Disorder? They allow for a
    hearing to be requested within 21 days. I'm really surprised if that is
    not clearly spelt out somewhere on the notice.

    I'd still write to my MP if in the same boat, especially if he/she happens
    to be from a party or New Labour faction that does not support G Brown. The
    more hectoring Chief Constables & the Home Office get over FPNs the better.
    We might even go back to to a situation where PCSOs have their crayons and
    FPN booklets taken off them so they can concentrate on their more useful
    duties, like helping old ladies & small children across roads.

    Haha. Those letters get increasingly narky and threatening. I don't
    have a TV or anything with an RF tuner in my house in England (nor a
    landline phone), and despite an email to them (no-one writes letters
    any more, right ?) they still mailshot me mercilessly.

    One particularly special letter promised me the area manager was
    making me a special case, and promised "special treatment" for me.

    Fucking retards. I have a house, therefore I must have a TV. Guilty
    unless proven innocent ....

  10. I find this TV licencing a bit weird. Do you have to licence each TV?
    What about the little USB receivers you plug into your PC? It's a
    bleeding receiver for christ sake. Licence transmitters, yes.

    I have a feeling the changes happening in media delivery might make TV
    licences obsolete?
