Insurance aftermath

  1. Remember Twatty who opened hs car door in the middle lane of the M25 so
he could have a stroll? And clobbered my Beemer?

Well, I made no claim on my own insurance, but claimed personally aganst
Twatty's and got paid out in about four weeks. Result. His use of a
wrong address and phone number that didn't fly didn't help his case, of
    course.

So this week I receieved a letter from Auntie Carole saying that as my
claim had been settled in my favour they've reinstated my NCB.

    <fx: dial, dial>

Hello? I didn't make a claim on my insurance at all. Did I?"

    "Erm... let me see..."

"No, I didn't. Not at all."

    "Erm...."

"Tell you what, give me the details on my claim form...."

"Er, no, you didn't, but we log it as a claim even when it's not."

    FFS.

This is not a new thing. I was involved in an accident some years ago and
informed the insurers of the /potential/ of a claim (which, in effect, is
    what you've done).

They removed the marker from their system when I was found not to be at
fault - but the other party's PI claim remains live for (IIRC) three
years, as does the /potential/ for a claim against your insurance.

Welcome to the world of the ambulance chaser and vicious lawyer...

But you informed them of the accident so they will have flagged it as a
possible claim anyway. This exposure will go in to their reports until
they are CERTAIN that no action is going to come from either party in
    due course.

They all do that sir (for regulatory reasons, I believe) though the
wisdom of sharing this info with the consumer is moot.

A 12 year old girl walked out in front of my wifes car about 2 years
ago. They collided and the girl got a broken shin. Luckily J was
parking so going very slowly. I hear the screaming in the house and
end up spending 20 mins on the side of the road 1st aiding until an
    ambo arrives.

Police investigation completly clears J. Parents of kids thank me for
looking after her at the scene and even write to J's insurers saying
there is no blame on J. J is distraught, of course and threatens to
    never drive again.

8 months later it's renewal time; double the premium. Phone calls tell
me the system has been marked to expect a claim, therefore all NCB
gone and it will stay this way for up to 3 years, even though they
know the above facts. NCB eventually reinstated but we can't get the
premium down to what it was before with anyone. Bastards.

Common practice nowadays, a claim was made against SOMEONES insurance
so its a claim on your record for your vehicle.

    Cunts.

Ditto, had same problem back in '99, despite the fact car had pulled out
on me and I was claiming against him (which took 2 years), because I was
FC it was treated as a claim against myself which was then chased ....
    bloody confusing.

    Christ, you are an idiot.

A potential claim against you counts as a claim - not as a claim simply
made against "someone" so therefore a record for your vehicle.

As an industry they're simply guarding against ambulance chasers or,
heaven forbid, people with genuine claims.

Had this when idiot man walked out in front of me in London. There was
no claim either way, but I still lost NCB for a couple of years.

    August 2009.

Claim for what? PI claims have a statutory limit of three years.

Now then, Brother Sweller! Just because crn's a fucking idiot, that's
(apparently) no reason to point it out.

It's become a meme, apparently, and is (so I've read) therefore no
    longer true.

Even if he is a fucking idiot (and he is).

Do they pay back the excess premium you have had to pay in the interim?

No, I mean what I said.

As the incident was disputed by the 3rd party, and because I was FC, the
cost of repair was set as a claim against my own insurance (ergo, myself)
and I had to wait for it t be cleared.

Some years ago some twat decided to park on top of my bike outside the
library, I did all the right things such as take details, notify the police
and insco, in spite of telling my insco that I played no part in the
incident - as I was in the library reading a book at the time, they
    cancelled my NCB.

Their excuse was that they expected the other driver to counter-claim.

    WTF!

I've had several calls over the last couple of years asking if I want to
pursue a claim against the third party in the accident I had in 2009.

When I point out it was 2006, not 2009, and the third party was a
toddler in a pushchair, they go away.
