Insurance Claim Question

    Had an off during the week. Hit one of those pesky scooters, Normally they
    just bounce off but this one brought me down.

    Now I am insured with Swann, he is insured with NRMA. Actually a nice guy
    who apologised and told the cops the truth and he got a ticket for the
    accident.

    I have been off work for 2 days so far - nothing broken but major soft
    tissue damage to knees and minor injuries elsewher. Unable to walk at the
    moment - tumbling down the road is not recommended.

    The question is - My 2002 Blackbird is insured for $10400 but the extras
    were not on the policy. Looks like the bike will be a write off. Also had my
    helmet, jacket, gloves, Mobile (Nokia N80) destroyed as well as ripped
    trousers.

    How do I get compensation for these items.

  2. I think you will need to take civil action to sue the scooter rider.
    You may be effectly be suing his insurance Co. as they will probably act on
    his behalf.

    Seek your own legal advise then treat it with a grain of salt as they, your
    lawyers/barrister,
    will only be too happy to lose the case at your expense.

    It's a risk vs. reward judgement on your head.

    Consult a lawyer and claim against the scooter rider.

    Get quotes for the replacement of the damaged items, at least 2 quotes
    for each if possible. Send the quotes with a letter of demand to the
    guy who caused the accident (or get a claim number from him and send
    them directly to his insurance company and cut out the middle man).

    The letter doesn't have to be anything flash. Just a statement that he
    caused the accident, that your stuff was damaged as a result of that
    accident, and that you have included quotes for the replacement of the
    stuff. Total up the lesser of the quotes and demand payment of that sum
    within a reasonable timeframe.. say 21 days.

    They will probably send an assessor to assess your gear, and you will be
    required to hand that stuff over to the assessor or the insurance
    company at some stage if/when they approve your claim... unless you
    accidentally stumble upon a way to keep it.. but I think I was just
    lucky. :)
