It's a write off.

  1. I did call them... they won't do anything. I'll call them again to see if he
    has made an attack, since he is at fault and all, i dont want my slowly
    building rating to be attacked.

    It's a depressingly common way to get cleaned up. It was the death of
    Clare's MZ for example. And I know of quite a few others who have had
    that problem.

    I dunno a good solution, except maybe if the cars in the lane to your
    right are stopped, move to the left of your lane. Gives you more room
    to swerve, and perhaps slightly more of a chance to see the car before
    it cleans you up.

    Just be very suspicious of any gaps in the stopped traffic in the other lane big enough for a
    car to come through.

    I'm always wary of the Keep Clear zones on roads when in traffic as you often get cars
    turning right from the other direction turning through what they think, is stopped traffic.

    I don't think it makes a difference, unless the person who waved him through
    is a cop. I think turning traffic has to give way to all oncoming traffic,
    whether they can see them or not.

    Geez talk about paranoid!!! He can't "attack" your insurance. They won't do
    anything until you make a claim. Most insurance companies will only take into
    account years in which _comprehensive_insurance_ is held when calculating your
    "rating". Most don't have any sort of rating system for TPO and TFT
    insurance.

    I don't see the point in duplicating letters... If he makes a claim, he will
    pass your letter on to the insurance company, if he doesn't make a claim,
    they will probably giggle as they throw your letter in the bin. Before you
    send the letter, call him and find out if he has made a claim, and if so what
    that claim number is, then deal direct with the insurance company and you need
    never speak or write to the driver again.

    So what should he do if the other driver doesn't make a claim and
    refuses to pay?
    not trying to be smart here i'm curious as to what one can do in this
    situation.

    In the past I have always forwarded a claim directly to the other guys
    company , making note of it in the letter to them ,always been paid
    after a reminder a few days later from the brother in law ( a Queens
    Council) but an ordinary Solicitors letter will suffice.

    approved about $2k of repairs to the superbike® after it's recent
    unfortunate "topple into a Saab when the tar melted under the
    centrestand" experience.)
