    I just had one of those expensive mornings. You know, the REALLY fucking
    expensive mornings. The ones where you have your Brief, Junior Council
    and Senior Council sitting in a room giving of their undivided
    attention.

    They were trying to give me a hard time, tempering my steel as it were.

    I don't think Senior Council has been called a **** recently :eek:))

    Yer man! How to spend money! I did an afternoon like that once.

    Cost me the best part of 10 'very' big ones. We all came up with
    different conclusions; but that was a good thing IYSWIM.

    Puts me in mind of the time I had to remind a barrister that as an
    expert witness my first duty lay to the Court. Should have seen his face
    when I informed him that I would be answering his questions as I saw fit
    and proper, not regurgitating the lines he wanted me to parrot.

    If you were attending court FOC, then you do have a duty to the court. If
    you were being paid by someone, you have a duty to the person that is paying
    you.

    Which part of the word 'first' did you not understand. BTW these were
    potential civil proceedings.

    "Experts always owe a duty to exercise reasonable skill and care to
    those instructing them, and to comply with any relevant professional
    code of ethics. However when they are instructed to give or prepare
    evidence for the purpose of civil proceedings in England and Wales they
    have an overriding duty to help the court on matters within their
    expertise (CPR 35.3). This duty overrides any obligation to the person
    instructing or paying them. Experts must not serve the exclusive
    interest of those who retain them."
