license suspension

    Hey guys, I was pulled over recently whilst on a suspended license and
    well seems like I will be facing the magistrates court. Now
    unfortunately for me this is my second suspension and seems like my
    driving record is atrocious to say the least so well am wondering what
    happens after this and what kind of fines/penalty am I looking at? Is
    there any way to argue the case in court or plead guilty and take the
    punishment. Hope someone here has been in a similiar situation and can
    offer some advice/help..

  3. Don't forget to think up some really good extenuating circumstances why you
    were a temporary nong at the time. These usually don't have to be
    verifiable but it helps to have some fine upstanding citizens, or even
    Johnny Howard, in the form of character statements, on your side if
    possible.

    In my experience, appealing the decision to a higher court even if guilty,
    on the grounds of harshness of penalty, can be pleasantly rewarding but
    it's been a long time.

    A guy I know got 3 months Jail, although it did involve drink driving as
    well as suspended license.
    Magistrates don't usually hae much time for serial offenders.

    My son got a $600 fine and a 12 month suspended sentence, he was lucky coz
    they wanted to lock him up there and then for 3 months.

    TROLL but lets play
    Mate of mine got done about earlier this year, while suspended,
    speeding, then while speeding again a week later.. 3 yrs loss of
    license, originally 9 mths fulltime, but somehow got it down to 12
    mths weekend detention.

    Plead your a fuckin idiot. may work.

    Yeah well i heard pleading guilty will help the sentence a bit. Seeing
    i have had one previous loss of license and well this is the first time
    i was caught driving while suspended i will have to try and make up a
    good excuse. SInce i wasnt speeding or anything just driving and cop
    did a routine check n got done. Thanks for the general outline and am
    gonna try n get me a lawyer to just argue my case even if i have no
    chance of beating the charge atleast try n get as small a fine as
    possible. How long does it usually take for court case to occur from
    when you are caught..any ideas??

  10. I usually find it's around 10am the next day just after they transfer you
    from the cells. Getting caught on Friday night is a bitch 'cause then you
    have to wait 'til Monday and the food sucks and the drunks wipe up all
    their spew with what's left of the dunny paper.

    If the coppers were nice enough to let you go home then read the bit of blue
    paper they gave you.

    If they were nice enough to let you ride home then keep riding hell for
    leather until said piece of blue paper turns up in the mail. Then ride
    nicely until the court date (this goes for appeals too).

    If it takes longer than six months (in NSW) then ignore it.

    Been there done that kinder both times lost the licence the only difference
    is when I took a laywer it cost me a lot more, so don't waste your money on
    a mouth piece for court, you were nabbed red handed, you knew your license
    was suspended and you made the choice to ride and got pulled over. Plead
    guilty take take the punishment and stay off the road.

    If he ends up getting prison time, I will personally offer to
    professionally wax your nutsack, Will.

    Putting people in jail costs more money than you can realistically
    simultaneously fine them for. The courts' aim is to save the government
    money.

    That said, the sort of fine and suspension the OP is looking at, he'll
    probably wish they'd locked him up...

    Speaking of the OP... more info, please. In which state did this happen?

    Not long enough... it still happens. A mate got a 3 year suspension and
    a ~$2200 fine incurred in magistrates' court reduced to a 1 year
    suspensio and a ~$1000 fine on appeal to the district court.

    When I tried it, I walked out of magistrates' court with something
    approaching $2000 in fines for a pair of dodgily-incurred 15-30 overs.
    Appealed to the district court, got them knocked down to court costs;
    chief justice's comments at the time, "There's certainly nothing in the
    case notes to indicate why a penalty of such severity was imposed, as Mr
    IK's actions are highly commonly seen on the roads..."

    It's almost like a form of meek idiot tax; if you go to court, cop a
    judgement two notches down from crucifixion and don't have the nous to
    appeal it, you deserve it.

    If you were a Pom, and I were sentencing you, you would get a free
    holiday for about four months, and a licence suspensioj for about five
    more years.
