    I have already come up with a draft. The two houses are literally 9
    minutes apart and it can all be backed up if required.
    I'll be fecked if I'll spend time ( = money > greater than fine ) going
    to court over it though.
    I just want to see the photo/vid. If its conclusive fair enough.
    If not then I guess they'll drop it?
    I wonder at what point you cross the rubicon and you lose the fine and
    points option?

    Rubbish. Even the Gogs would be hard put even to prove intent to speed, let
    alone what is effectively conspiracy.

    Hmm. Its a definite that 3 people in this instance did *not* jointly set
    out to exceed the speed limit. Only one is guilty and none of us were
    aware we had even committed a crime until the NIP arrived.
    I'm assuming the police have enough evidence to show me which of us it
    was.
    Providing the visual evidence will save everyone a lot of time and
    money.
    Not sure what it means if one of us just allows ourselves to be
    prosecuted without seeing the evidence.....

    Also, if you plead guilty, you could lay yourself open to a charge of
    perjury if the photographic evidence subsequently shows it to be someone
    else driving.

    See a lawyer, you're AFAIR entitled as see the evidence[1]. Tell them
    it could be anyone of 3 drivers and without the photo you can't tell.
    It's worked for several police forces as a get out for the coppers.

    [1] The father of a work colleague had a similar situation, however,
    he got the picture which, showed him as the driver.

    It appears a simple e-mail will get us the photograph but it may be of
    the rear of the car in which case we will have to go to court to sort
    out who was driving.......

    Its like trying to cross a South American border..'just hand over the
    money gringo..'

  12. Not in this case. There's a bit of a difference between "We were all
    driving along that road that day but we're not sure who was driving at
    that precise time" when there's a good reason to believe people are
    telling the truth and a chorus of "I didn't drive that car that day"
    when it's obvious somebody is lying.

    If Mark is doing his best to identify the driver (as he seems to be)
    then he should be in the clear if there's no evidence one way or the
    other,

    Heh!

    I suspect that bit of chat will have to be conducted in a court room :)
    Its probably not going to help me keep the costs down.........

    The photo acquisition went well; so far.

    Just emailed them briefly :

    'We are not sure which driver it was; it would be helpful if you could

    send us the photograph.'

    I decided against the purple prose...

    And got the following:

    'I write in relation to your recent email, the content of which has been
    noted.
     

    Due to data protection guidelines photographic evidence will be
    forwarded via the postal service'

    I bet its me.......................

    Big bright light ?
    Flashes twice ?

    Not having been caught that way, I don't know if I would miss it or not.
    If dark, not, if daylight then maybe.

    But reading down, he thinks it was a camera van, not sure they would have
    done him from the rear on one of those (unless BGN was on board).

    Or an unmarked car with a video camera.
    Possibly one of them sneaky vid cameras on a tripod they also use round
    here sometimes..
    I don't recall seeing a horsebox either...

    I was caught twice by a GATSO or similar. The first time was at night, and
    there was a distinct flash that was noticed by all in the car - the NIP a
    couple of weeks later was not a surprise. The second time was in broad
    daylight and this time the NIP was a complete surprise.
