Oh,bother...

    ....or in other words, **** **** **** ****, fuckity fucking ****!!! My
    shiny, nearly new SAAB 95 isn't so shiny now. I was coming back from the
    supermarket, waiting at traffic lights to turn right. The lights changed to
    green, the visible traffic on the road I'm turning into had stopped - so I
    pull out to turn right when I become aware of a car heading toward me at a
    considerable rate of knots. Wham, right into my offside rear. The panels
    are fucked and as the wheel took much of the impact the suspension on that
    side is fucked too.

    The blind bint in the other car swears the lights were green for her. The
    bad news for her is that the bloke who was behind me in the queue stopped
    and gave me his contact details. He is willing to confirm that the light
    was green for me and that she must have gone through a red. However, I have
    no great confidence that my insco will do the right thing so even with my
    witness it could end up as knock-for-knock. The possibility of being out of
    pocket is bad enough but then there's all the hassle that goes with the
    aftermath of a collision. Still, at least I'm a all-year, all-weather
    motorcyclist so I will be OK for commuting to work etc.

    The phrase "Knock for Knock" doesn't actually mean the blame is
    proportioned, it refers to a claims agreement which may or may not
    exist between your two insurers, whereby losses are not recovered, and
    ultimate liability (and loss of NCD) is established purely on the basis
    of which driver is able to fully recover their uninsured losses.

    I know - but if they don't successfully pursue her for all of it then I will
    lose NCD and voluntary excess plus the cost of recovery regardless of
    apportioning blame. Still, my odds are improved by having an independant
    witness who stopped and provided his contact details. However, I really
    don't trust inscos.

    Heh, the point of Knock For Knock agreements is that recovery of
    uninsured losses (by you) decides who loses their NCD. The insurers
    have an agreement whereby they simply don't bother, which apparently
    saves costs.

    Having a witness is obviously a good thing, hopefully the other party
    will also be insured. It would be even better if a knock for knock
    agreement between the 2 inscos does not exist.

    Not trusting Inscos is a good thing.

    Things are looking up. I just had a call from her insco offereing to
    undertake all required repairs, loan car etc. "without prejudice".
    Apparently she still hasn't admitted liability but it looks like they don't
    believe her. The fact that I have an independant witness (I told her this)
    may have swayed their view. The fact that she was approaching the lights at
    speed whilst I had been waiting for the lights to change before moving off
    also makes it unlikely that I was at fault. After all, why would I wait for
    a minute of so then suddenly decide that a red light was actually a green
    light? It probably also helps that a SAAB 95 is often considered to be a
    boring old fart's car and I am (on paper at least) a 60-year old, solid,
    middle-class, citizen with a clean licence an no recent claims. Also, I am
    fully comp and she is 3rd party.

    I reckon that her insco has decided that the odds are definitely against
    them and have decided to settle rather than risk wasting money on a case
    that they would probably eventually lose.
