    Knowing how popular these are on UKRM, I thought I'd share this one,
    emailed to me by my friendly neighbourhood dynotesting man.

    Seems Castle Combe is in danger of being closed.

    An utter waste of time. The petition people are being asked to sign is:

    a) Written by an illiterate
    b) Doesn't give any arguments why the circuit should stay open.

    Additionally... why would councillors in Chippenham give a **** about
    the views of people 'on the internet'? They're only going to be
    motivated by local voters and local businesses.

    The person who put the petition together seems to come from Weston Super
    Mare which also gives him no link to the councillors. If he had an
    ounce of common sense[1] he'd have got someone local, with influence, to
    put the petition together; i.e. the owners of Castle Combe or one of the
    associated businesses someone who employs locals and pays taxes.

    I would sign it but given how badly it's written and how poorly it's
    thought out I don't want to associate with it.


    [1] Originator is an 18 year old who works on Weston Pier...

    They may also be motivated by their statutory duties.
    I suspect any threat of closure comes from the circuit owners
    themselves.

    The same issues are raised in respect of this scenario as other racing
    circuits with noise problems. I read a very interesting Ombudsman's
    report about Silverstone a few years ago.

    The Alton Towers case also makes interesting reading if you want to see
    how determined complainants can use the law to control venues which give
    pleasure and employment to many.

    It's an area of law which could do with some attention. Not going to happen
    in this country though, sadly.

    Indeed. A review of statute law, would in itself, not be sufficient
    without radical reinterpretation of the common law of tort and nuisance
    enshrined in cases such as Sturges v Bridgman.

    Balancing conflicting interests has never been easy and 'human rights'
    legislation has not made it any easier.

    Having said that, there have been one or two cases in recent years which
    give some indication that, the Lords at least, are of the opinion that
    specific statute law can deny a plaintiff common law redress. Well
    that's how I read this case anyway: Marcic v Thames Water Utilities Ltd.
