I don't think so, you're thinking of medical procedures, not shagging. Just
because he *told* her it was a magic minge potion and she was stupid enough
to believe it, doesn't make him a doctor or the cream a medicine.

 

More to the point (in this guy's case), how desperate would you have to be
to discover that the woman has herpes, *then* con her into having sex with
you?!

 

It does have to be informed: otherwise it would not be rape if the
woman were drunk to the point of being almost unconscious, if she had
learning difficulties, if she were under eighteen and innocent [1], or
if she were simply a bit thick.

[1] I am told that the case law on this one in Ireland relates to a
girl who was told that it was a tonsil operation. SWK might be able
to track down the case.
