    Yeah.
Justice Heather Hallett at the High Court ruled that the lower court
judge had erred and that the case should be referred back for a fresh
hearing. "Driving at those speeds on public roads without any warning in
conditions no matter how good, and no matter what the skills of the
driver, amounted to dangerous driving," said Hallett.

What complete and utter fucking bollocks. Clearly we need men with red
flags out in front of us again. Alternatively one could suggest that
anyone who cannot learn to drive safely at 160mph on a quiet road
    shouldn't be given a licence.

There was a case recently where a bloke in a sports car was nicked doing
about 170 on a motorway and was hauled up for dangerous driving. The
jury acquitted him, on the grounds that while his speed was excessive,
there was no indication that it was specifically dangerous given things
like the condition of the vehicle and his driving record.

He'll be nailed for the speeding as a separate offence, but dangerous
didn't stick. Evidently Ms Hallett hasn't looked at the case law.

Er, no. It was /fitted/ to to the car in question. What no-one has been
able or willing to explain, is why the prosecution came about in the first
    place.
While the guy was not under instruction per se, when class 1 drivers are on
their refresher training, three figure speeds on A roads are common.
I just wonder if he 'failed the attitude test' with some superior or
    another.

    Still, whatever.

I wish it was the same for us but I'm glad someone's got off with an
absolute discharge even though he's plod. It sets a precedent which
one day someone else may be able to exploit.

I don't really gaf. Somebody beat the system (or played it better than
I could) so good luck to them.
