    Depends on the definition.
    Is this one of those tough guy contests where we try and out tough each
    other with the written word on usenet? I think I gave that lark up quite a
    few years ago.

    Well I'll tell you how court goes, but after that, well I don't want to
    incriminate myself.
    Er, there power as a city council? Did I miss something there?

    Last time I went to court every parking fine got off. Every single one of
    them.

    Out of interest what exactly is the lesson? (honestly I'd love to hear your
    take on it, because mine so far is that councils are greedy and that
    obediance to a little sign does not distinguish a good person from a bad
    one)

    Besides; Pisshead isn't disabled. He's about the most "able" bloke I know!
    Sure he's got a disablity or two (who hasn't?) but that doesn't get in the
    way of him living his life!
    Don't park in his parking spots if you wanna' keep living yours.

  4. I suppose in the interests of "full disclosure" I should make it known
    that I've worked for a quadraplegic boss for over 11 years now, and guys
    like him _really_ don't need extra hurdles thrown in front of them by
    arrogant pricks illegally using disabled parking spots. You think your
    life's hard because someone gave you a $400 parking fine? Try breaking
    your neck...

    For homework, read the chapter about how arguing when you've been caught
    doing the wrong thing about how you don't like the penalty they applied,
    makes you look like a dickhead.

    Hard to say if it's justified or not; I reckon that it's easily
    justifiable.
    If it's stopping someone from accessing a care-facility that they need and
    causing them to be subjected to hardship and / or humiliation then a mere
    $400 fine seems pretty paltry by comparison.

    Ah but the parking spot is not necessarily going to be available anyway.
    Let's say that a real disabled person was parked there, what would the next
    disabled person do then? They are equally inconvenience yet not penalty is
    dished out.
    Parking in a disabled spot is equal to parking in a regular spot over you
    alotted time. The end result is someone who may have been able to park there
    has to find somewhere else to park. Therefore the penalty should be equal.

    But his disability isn't my fault, keep it in context.
    The simple fact that no-one parks in this spot ever, in all my years, I've
    never ever seen anything parked in this spot ever. And there's actually
    enough space for two or three bikes, so even if Wheelchair Willy did come
    along, he'd still have a space.
    In any case my point is not that I should be allowed to park there, it is
    that the penalty should fit the offence (ie bugger all)

  16. Warning of the amount of the fine needs to be given. That might work
    even better than just sticking up a sign.

    I don't want any disabled person to suffer but that fine is out of
    proportion to the offence, espeically when it's not posted how much the
    fine is.

    Make sure you use those *exact* words in your appeal of the fine.
    So, just to clarify this, you parked in a disabled space on purpose,
    right? You took a calculated risk that a parking inspector won't happen
    along and, should that not eventuate, that the fine you get issued with
    will be of a negligible amount.

    The more you go on trying to defend this, both your actions and your
    reasoning lead me ask why you haven't tried applying for a disabled
    sticker yourself... if you're prepared to argue before a magistrate, let
    alone a group of people whose social outlook you should be well familiar
    with, that you shouldn't have to pay a fine the amount of which you
    consider to be unfair, you might as well argue that if physical
    disability entitles one to a disabled parking sticker, so should an
    advanced case of cretenism.
