    Like I said, I think they were both liable to some extent. There may have
    been a "legitimate gap" but that doesn't entitle the car driver to pull out
    through it without looking. The law would appear to agree - most accidents
    of this kind seem to have been settled on a proportionate basis.

    No, no, no. The attitude to take is that it's all the fault of the
    car. He had a Give Way line to cross, so the solicitor could argue
    that it was a straight right-of-way violation. But there are people
    who are paid to argue for things like this and know what they're
    doing.

    It won't be my opinion that matters. Anyway, I will try to make sure that
    he gets as much as he can. However, having looked at some of the
    precedents, the odds are that it will be a proportionate settlement with
    each being held to have had some responsibility.

    Exactly what happened to a mate of mine. The car driver was found to be
    100% at fault, and much money changed hand in compensation. This was
    about 20 years ago though.
    I hope your son heals quickly with no long term problems. Besh wishes.

  6. Exactly what happened to me about 20 years ago. Only I was in the car
    pulling out through the gap in stationary traffic. Some twat in an
    Escort was creating an extra lane and racing for the lights.

    He was blatantly in the wrong. He got away with it because "this road,
    although 1 lane, was regularly used by locals as if it were 2 lanes". I
    should have known this and waited until there was no traffic to my right
    before pulling out.

    I got done for careless driving. A couple of days later a sign went up
    saying "no right turn at the lights" ie; don't create an extra lane.

    Oh, and the boy racer from the Escort turned up at court hand in hand
    with *my* witness who had sworn at the scene that laddo was on the wrong
    side of the road and speeding. He had a sudden memory lapse.

    I'm not bitter. I'm retired.
