  7. Trouble is, for me it's effing miles away. It's a 500-mile round trip
    just to collect.

    I've just missed out on another one much closer to home - I bid a grand,
    auction timed out with me the high bidder, but didn't meet reserve. The
    fact that he got the model name wrong probably meant it slipped through
    some people's searches.

    I asked the seller what he was after, 'cos the auction description was
    basically shite and I was taking a chance. He said £1200. So I've asked
    the questions that he didn't reply to before, and said I'd go to £1200
    if it checked out.

    Plan is basically to swap over the scuffed bits on mine with the decent
    bits on this one (same colour, see) and then just flog it on.

    A few months ago I'd have snapped that up.

    I know they have a good reputation for parts - but surely they're not
    allowed to put this in their auction: 'please note that the bikes are
    sold as seen with no warranty'?

    I thought traders weren't allowed to sell stuff on to the public as
    'sold as seen'?

    I don't think they can legitimately claim that, though - given the
    number of complete bikes they shift through ebay.

    But yes, you probably have a point, 'no warranty' and an ebay sale from
    a dealer is never a good sign.

    back to me, and if not, then I might take you and Benj up on their
    offers.

    Though I'm with Hog - exd-Plod bikes are the kiss of death come resale
    time.

    I think they probably value their reputation at a slightly higher
    figure than they're selling the bike for and if they sold too many
    snotters their reputation would be fucked.

    Well we discovered this with my white one which was as clean and well sorted
    as could be. This 97 bike is missing the full pannier frame and topbox and
    other Highline goodies which would be serious wonga to replicate so it's
    always going to be Plod.

    Q: I sold a car yesterday to a consumer for £500. At such a low price, I
    told him it was 'sold as seen'. He accepted this. Now, he's complained
    because the exhaust has fallen off, and he sys the clutch is going. I've
    told him that he agreed it was sold as seen and he hasn't any comeback.


    'A: Sold as seen' in this context is a meaningless statement. You can
    only apply this reasonably to the way the car looks, or something that
    can be easily seen on a visual inspection, perhaps scratched or dented
    bodywork for example. However, it is not reasonable to expect a faulty
    exhaust or clutch to be picked up on the basis of a visual examination,
    and the consumer is probably entitled to complain. This soon into the
    contract, the Sale of Goods Act 1979 (as amended) would most likely
    allow him to reject the car and have a full refund.

    Using the term 'sold as seen' in these circumstances may also be a
    criminal offence under the Consumer Transactions (Restrictions on
    Statements) Order, as it would be seen as an attempt to restrict a
    consumer's legal rights. If you want to use any disclaimers, either in
    contracts or in signs on the garage premises, it is best to seek advice
    from Trading Standards or your company solicitor first.

    Note the second bullet point. All the phrase means is that the buyer is
    invited to inspect the vehicle before completing the sale as no warranty
    is given. All of the other points still apply, i.e. the vehicle must be
    as advertised and fit for purpose taking age etc into account. They describe
    it as in "ride away" and "very good" condition" so if the gearbox packs
    up in the first few weeks then you could ask them to fix it. If you fail to
    spot an oil leak before handing over the cash then that might be tough shit.
    The gearbox fault stops it being "ride away condition", the oil leak is not
    likely to be terminal and to be expected on a 12 year old bike.

    I washed mine the other day - after riding it to Stroud and back in the
    rain (kept me remarkably dry, though) - it's still a big ugly purple
    heap of crap. But I like it.
