Speed camera ticket

  1. I live in FNQ but ventured South last Feb (2006), and a few days ago I got a
    NSW speed camera ticket, that is a year old.

    Yes I will pay the thing, but a bit rough them taking all this time to send
    me the notice.

    How can you remember what happened a year ago.......

    The last one they sent me (again from NSW) was on a vehicle owned by me and
    had passed through 3 different states rego dept, and it finally turned out
    to be read wrongly and was not my vehicle, of course I got a apology, like
    hell.

    I reckon you should write to them and post exactly THAT!
    You regularly travel into northern NSW but them waiting 12 months to notify
    you of the offence has totally denied you the ability to defend the
    accusation as you have no recollection of the specific time and date that
    they're alleging the offence occurred.
    Mind you; I've never gotten off a ticket in my life so you may wanna' listen
    to somebody else!

    It's a NSW legislative assembly hansard extract relating to Infringement
    notice payment policy. It contains the phrase "The statute of
    limitations, in relation to traffic act matters is 6 months, under the
    provisions of section 56(1) of the Justices Act."

    I haven't read the whole lot, or looked at that section of the Justice
    Act, but you should.

    The Government has since taken steps to improve the efficiency of the IPB
    including increasing staff, but it is also taking action to reduce the risk
    of a fines backlog occurring in future. Last year the limitation period for
    commencing proceedings for owner-onus offences, such as speeding, red light
    and parking offences, was extended from 6 to 12 months.

    Ask for a copy of he photo. It will cost you $11

    You do not have to pay until it is provided and you never know, it may
    be another vehicle.

    I agree I have used this defence once before when I contested a ticket, the
    police officer who issued the ticket fell off his police motorcycle and was
    on extended leave to recover 18 months later they brought the matter before
    the court. I requested that the judge throw the matter out as the delay had
    substantially reduced my ability to mount a defence. He agreed and I walked
    out.

    In WA they now send you two photos on the initial notification. One of the
    driver and a close-up of the plate. I got one a few weeks ago for one of the
    company cars. Black and white photos on cheap paper but no question as to
    who was driving. Not me.

    Yep, Queensland does too (Don't ask me how I know)

    ....but this is NSW we are talking about here.

    if it was issued more than 6 months after the incident, its statute bared!

    ie they cant proceed with it!

    I rear ended someone while driving a car and was interviewed by cops six
    months later then after another delay charged with dangerous driving.
    The incident happened when the bloke in front of me stopped to turn
    right about 5 metres after leaving a traffic light. Damage to both cars,
    no injuries.

    The cops made a big thing about how I said I couldn't remember details
    of the incident or recall speed when interviewed, without mentioning
    delay. I agreed with them, but explained the delay before interviewed,
    agreed that technically I was guilty, showed the magistrate my otherwise
    clean sheet, and got a no conviction recorded.

    If it had been sonething arguable, like speed, I would have argued
    reduced ability to defend. Two banged up cars is a little more difficult
    to explain away.

    IIRC, WA lasws state that they (the police) have to prove who the
    driver is, in most other states in up to the owner of the vehicle the
    prove who was or was no driving...
