Ticket Advice

    This is not that big a deal, but I'll ask anyway....

    Got pulled over by CHP last weekend doing 80. He told me the plane
    spotted me, he didn't give a ticket for speeding but did for not
    having my registration with me. He was very polite, no problems
    there... question I have is that I had read some time ago that if the
    ticket is not written up correctly, i.e. there are problems with the
    accuracy of information, it gets thrown out... The bike is a 95, he
    wrote 85, and my license has digits wrong... Can someone tell me if I
    can get this voided and if yes, how?

    In my case, I just brought the reg cert to the courthouse after I renewed,
    and they dismissed the tickets for $10 ea (this was one in Santa Cruz and
    one in Santa Clara). You may not even need to drop that extra $15.

    Almost zero chance. There's no such thing as an "automatic void"--that's
    urban myth. The whole ticket being wrong thing can be used as evidence
    that he wasn't very observant, which could work to your favor in a speeding
    ticket case. For a registration ticket? Forget it. Just pay your $10
    fixit.

    DMV will sign off that you have plate and reg for free. But you should make

    In this case...the officer gave you a huge break...and a totally minor
    ticket.. if there is a small fine just pay it. If its a disproportionate
    fine go to court and tell the judge about justice and respect for the law
    a.. and that rip off fines are not good for anyone... not even the court.
    Its a justice issue.


    Speak with authority..you want the other 100 people in the court and the
    balifs etc to hear you.



    Forget the ticket errors...you owe the cop something. and you will do
    better in life for taking that approach as well...actually that way of life
    just keeps on getting better.


    If you get a bogus ticket though...say doing 35 in a 25 when it was an open
    deserted road with perfect visibility.....here is what to do....go to the
    www and look up the actual speed law cited on the ticket.....parse every
    word and look for ways in which you have not violated it.

    You will find that the 'basic speed law' (forgot section) applies...and that
    has nothing to with the sign in all but maximum freeway speed postings in
    most cases. go to court and present that case. If it was also a radar
    ticket, search that on google and notice that when you pass those staionary
    radar speed signs that show your speed...that it varies all over the map
    depending on the shape of your vehicle, weather, passing ducks...people
    farting...etc.. bogus in other words. Present that too.

    Be entirely respectful...but be complete and outspoken. If the court
    jabbers something at you, get the specifics from them in writing..VC code
    numbers, any law cited...ask for a copy of all that...tney have to give it
    to you. Sometimes they will refuse. thats illegal. a court can just
    stuff you without citing the law on which it operates.

    When it does, you read the law cited..often you will find its not even
    remotely applicable to your situation...smoke from the court. Traffic
    courts are in business to make money for the city...not for any other
    reason... they claim safety and thats true to some extent..but if it were
    only safety they would not be issuing such bogus tickets, violating the law
    with hair splits... and in the case of SF stating in public that its a money
    raizing measure overtly. and putting officers on a quota in order to
    increase badly needed revenue.

    Other cities are installing red light cameras...and when those fail to suck
    in enough money, they are cutting the yellow lite times to 2 seconds,
    trapping drivers.... total criminality from those cities you see? Proof
    too...and while increasing rear end accidents that kill people....all to
    raise revenue.

    so you see? It isnt justice or safety in those and many other cases...its a
    crime.





    I also presented the notion that hiding cops in the bushes to raise money by
    spitting hairs with drivers, while tripling thier insurance rates, to net a
    $100 fine is both a violation of the purpose of the law, perverts justice,
    and causes 300% more finanicial damage to the driver than money collected by
    the city.

    Do this before a court room full of people...and promise (gently) to appeall
    or go to a jury trial if necessary. The city does not want its rip off
    game exposed like that...

    take carefull notes and review each law cited ,make the court cite you both
    case law and VC code numbers...get it writing from the court clerk as you st
    and there....then go home and look those up at the states VC site...you will
    find in many cases that they do not have a case.

    Even the DMV is complicit on thier recent driving test..it says that the
    posted street speed limits are maximums.... thats not always the case
    actually...its the basic speed law that is senior last time I looked and won
    the court case (last year in calif. marin county).

    There is also basic law on what comprises justice itself.

    For instance it is not just to fine a bag lady for jay walking if its going
    to mean she doesnt eat for a month... Regardless of what some statute
    says... Justice is integral with the law even though that is heavily
    perverted.

    You have a chance to make these points before an audience when you get a
    bogus ticket or whatever.... dont miss the opportunity. a hundred people
    came to hear that message. the judge needs to know that you know its a rip
    off too.

    crime issues from the courts about as often or more often than it issues
    from the street.....it doesnt take much research to find that out, clear to
    the death row issue with the state refusing to do DNA tests to prove for
    against an inmate in many cases...and when they do, 4 times out of 10 the
    inmate is proven innocent...... abject corruption you see.

    Know that when you go to court...look for the lies and corruption. It will
    very often be there in *spades. then make a big issue of it as you stand
    before the court and its host of victims seated behind you.

    It will be vastly good for your head as well...and good practice.

    The larger govt corruption mess is not getting any better...especially as
    the state is 38 billion dollars in the hole, and the tax payers are tapped
    out more each day.
