    I don't think an accident that happens to someone else, a quarter of a
    mile away, and a short wait for Plod to move the vehicles to the hard
    shoulder, counts as an emergency sufficient to justiyf going
    walkabout. YMMV etc.

    Personally I wouldn't. Every time I've ever been able to see, the bill
    have been telling people to get back in their cars under these
    circumstances.

    Also: The motorway hadn't been completely stopped. Bike traffic was
    mostly un-affected ;)


    ISTBC though.

    I don't either. My point was that the claim would introduce enough doubt for
    plod to walk away from it (they need little enough excuse at the best of
    times).

  14. Opening the door whilst a driver in charge is still an act of driving,
    so, what used to be simple 'due care, etc' would cover it, imo. Dunno if
    it's been fucked with.

    I've sent him a nice polite letter pointing out the road traffic
    legislation referred to in this thread (thank you, all), requesting
    his real address and reminding him of the law regarding to registering
    and insuring vehicles at defunct addresses, and recommending that he
    see sense, cough privately for the damage, and ignore his father's so-
    called 'advice'.

    Strongly tempted to post it here, actually.

    I wouldn't hold your breath.

    Do you have any legal protection on your insurance policy? Did you check
    his number on askmid?

    I would just try to find out his insco details and just go direct to
    them. Failing that insist plod do something about it - or initiate a
    small claim against him.

    IIRC, when exiting a car it is the exitees responsability to check traffic
    is clear before opening door.

    If entering car, there is an element of responsabilty on motorist
    approaching the vehicle to have noticed someone was standing next to the
    car.

    FWIW, I was once dropping someone off, when they got out without looking and
    twatted a car, as driver I was held responsible.
