What`ll he get?

    Mate of mine got caught speeding today.

    The idiot was barreling down the M1 between Leicester and Northampton and
    failed to notice he was being followed by a suspicious looking Volvo for a
    full 7 miles!

    They`ve clocked him at an average of 145mph for these 7.1 miles or so
    (vascar I presume).
    Taken into the back of the car and given a lecture but nothing on video and
    told it`ll be passed over for prosecution (so he`ll be waiting for a NIP
    then?).

    Also warned about his single line number plate.

    No other crimes were mentioned (reckless or dangerous driving), road was
    reasonably empty (he says), full clean license and no points.

    I had no idea what to say to him about the possible outcome and just
    wondered what The Font in it`s collective wisdom reacons the punishment will
    be?

    Ban (more than likely but how long?) points? fine? Jail (it`s been known to
    happen :-(

    That sounds a bit iffy. That's a hell of a long distance for them to be
    recording an 'average' speed.

    Quite a high average, too - can't see how he could have held that kind
    of speed for 7 miles without a car baulking him and forcing him to drop
    down to half that.
    **** knows. If I were to make a wild guess, I'd reckon on the thick end
    of a £500 fine and 6 month ban, at least.

    It really depends on the day but it will certainly go to court. The minimum
    would be a six month ban but it could easily be 30 days inside. If they take
    it as serious dangerous driving it could be up to two years imprisonment.

    Only 3 minutes, thobut.
    If something sat behind me for more than 20 seconds at that speed, I'd be
    very suspicious.

    Is the correct answer. Decision on what to do him for will involve
    Crown Prosecution Service and how many others were caught on the day
    and how fast they were doing. If it really was a 7 mile chase then a
    few days inside are highly likely. OH and on the day wear a suit
    collar and tie and be ever so evers humble

    And the defence would be - if it was dangerous, why did they let him do it
    for 7 miles?

    The guy's in trouble, no mistake, but I would wait and see what they come up
    with in writing. The 145mph claim might just be an opening bid, as it were.
    When I was much younger I was pulled for speeding in a 30. The cop who
    stopped me *said* I was doing up between 60 and 70, but that he would only
    put 50 down on the paperwork. I was happy to agree with that - it was only
    later that I realised he probably was flying a kite. As I said, I was quite
    young when that happened.

    They do that, don't they? I got a "You were doing well over 100, but
    you were driving safely.. I could take this to court, but in this case,
    as you clearly realise your mistake I'm prepared to say in excess of
    the speed limit and issue a fixed penalty and 3 points."

    I wasn't unhappy with the outcome, as I knew I'd been doing over a ton.

    Thanks for the replies but I won`t tell him any general concensus even
    though a ban seems inevitable (for which he`ll lose his job) and wait and
    see what the CPS throw at him in way of charges.

    Agreed that it does seem strange (to say the least) that they followed him
    for 7 miles at 145 before pulling him.
    Maybe there is some room for manouvre here when it comes to court.
    I`ll post the outcome.

  15. Plod nabbed me just on the exit from Regent's Park once.

    "Do you know we were doing 60 to catch you up?", he said.

    <shrug> "Hardly surprising, given I passed you mile back and you just
    sat there for ages", was my reply.

    Then I nutted the WPC, totally by accident, as she dropped her notebook
    and we both bent down to pick it up. Nice, she was.

    Are you sure that he's completely clear that that's what was said? Might
    it have been that they were following him for 7 miles at speeds of up to
    145?

    Could be very bad, or could be nothing, depending on your solicitor
    and the court...

    I had a similar incident a few years ago (before excessive speeding
    was classed as dangerous driving). Unmarked car followed me for
    similar distance, estimating my speed at over 145 since they could
    only do 134 in their Vento. I thought it was just a speeder following
    me, since the car kept trying to keep up through roadworks, where we
    were down to a crawl through single line traffic. No flashing lights
    or siren visible/audible by me. I mentioned that I thought he was
    just someone who either wanted to catch me or had a grudge that I'd
    passed through the roadworks quicker than him, so I was actually
    trying to get away from him.

    They came round the next day to see me and advised that I should plead
    guilty, since the video wouldn't be shown in court so I wouldn't be
    hung out to dry. I suggested they weren't solicitors, so shouldn't
    advise, and I'd let my solicitor view the video.

    They duly sent it to a solicitor I found who looked at it and remarked
    that the police driving was far worse than mine. I did all my
    lifesavers, kept lane discipline (on a fairly quiet road), indicated
    where necessary etc, whereas the unmarked car had to cross lanes on
    the dual carriageway often at the speeds he was doing. I argued that
    at 130mph he was at the limit of his vehicle's capabilities, whereas
    my Blackbird had plenty in reserve and was built to travel safely at
    these speeds. No other road users were compromised by me, but as I
    left the road at a small exit (no sliproad) the video shows the police
    car stopping in the main carriageway, smoke pouring from the tyres.
    They were unable to stop before the exit, so reversed back along the
    main carriageway, causing lorries to pull out to overtake. Looked
    more dangerous than my driving, so we pleaded guilty to the earier
    vascar reading of 94mph and argued the dangerous driving charge, since
    my solicitor found a (Scottish) case where it was succesfully argued
    that speed in itself doesn't constitute dangerous driving. We
    requested that the DPS viewed the video to agree/disagree with our
    view, and over a years worth of adjournments they never did look at
    the video. In the end the magistrates got fed up with them.

    At the final hearing the DPS requested another adjournment, which was
    about to be given, since their main witness hadn't turned up (the
    police driver), but my brief argued that the case should continue that
    day as I had religiously attended many hearings over more than 9
    months and that if I hadn't turned up the case would have proceeded in
    my absence. They agreed and the DPS pulled out. I was left with 6
    points and £150 for the 96mph, and a copy of the video, which makes me
    look quite good but my arse looks too big on the Blackbird :)
